Frequently Asked Questions
What is commercial auto insurance?
Insurance that protects vehicles used for business purposes. It covers liability for bodily injury and property damage you cause to others, physical damage to your own vehicles (collision and comprehensive), medical payments, uninsured motorist coverage, and specialized endorsements like hired and non-owned auto. Unlike personal auto, commercial policies cover multiple drivers, provide higher limits, and are designed for business use.
Do I need commercial auto insurance?
Yes, if you use any vehicle for business in New York. This includes vehicles registered to a business, vehicles used for deliveries or hauling, for-hire transportation, and even personal cars used regularly for work activities. Your personal auto policy excludes business use and will deny claims that occur during work. NY state law requires liability insurance on all commercially registered vehicles.
How much does commercial auto insurance cost?
$1,800-$18,000 per vehicle per year in New York, depending on vehicle type, driver history, coverage limits, and business use. Work pickups cost $1,800-$3,500/yr, box trucks $3,500-$7,000/yr, and semi-trucks $8,000-$18,000/yr. Fleet policies (3+ vehicles) save 10-20%. See our detailed cost guide.
What does commercial auto insurance cover?
Liability, physical damage, medical payments, and specialized business coverages. A standard commercial auto policy includes bodily injury and property damage liability, collision and comprehensive coverage, PIP/medical payments, and uninsured/underinsured motorist. Optional endorsements include hired and non-owned auto (HNOA), cargo coverage, trailer interchange, and MCS-90 for interstate carriers.
What is the difference between commercial and personal auto insurance?
Commercial auto covers business-owned vehicles with higher limits and multi-driver coverage; personal auto excludes business use entirely. If you are in an accident during work, your personal insurer will deny the claim. Commercial policies also offer specialized coverages like HNOA, cargo insurance, and DOT/FMCSA compliance that personal policies never include. See our full comparison.
What are the commercial auto insurance requirements in New York?
$25,000/$50,000 bodily injury, $10,000 property damage, $50,000 PIP, and $25,000/$50,000 uninsured motorist. Interstate carriers need $750,000 CSL minimum per FMCSA. See our full requirements guide.
How many vehicles do I need for fleet insurance?
As few as 3 vehicles at First Heritage Insurance Agency. Most insurers require 2-5 vehicles minimum. Fleet policies consolidate all vehicles under one policy, simplify administration, and qualify for 10-20% volume discounts versus individual policies. Learn more about fleet insurance.
What is hired and non-owned auto insurance (HNOA)?
Coverage for vehicles your business uses but does not own. Hired auto covers rented or leased vehicles. Non-owned auto covers employees using their personal cars for work. If employees ever drive their own cars for errands, deliveries, or client visits, HNOA is critical. It costs $200-$600/year. Learn more about HNOA.
Why is commercial auto insurance so expensive?
Nuclear verdicts, social inflation, and rising repair costs. In 2024, 135 nuclear verdicts (jury awards over $10M) totaled $31.3 billion in commercial auto cases. Social inflation has added $70.8 billion to liability losses over the past decade. Repair costs are up 36% since 2021. In New York specifically, the $50,000 mandatory PIP and aggressive litigation environment add further cost.
How can I lower my commercial auto insurance premium?
Work with an independent broker, implement fleet safety programs, and use telematics. Telematics-based safe driving programs save up to 30%. Other strategies: maintain clean driver MVRs, increase deductibles on older vehicles, bundle commercial auto with GL, and compare quotes across multiple carriers. First Heritage Insurance Agency clients typically save 15-30% by comparing 50+ carriers.
Do independent contractors need commercial auto insurance?
Yes. As a 1099 contractor, you are your own business. Your personal auto policy excludes business use. If you drive to job sites, carry tools or equipment, or transport materials, you need commercial auto. General contractors increasingly require subcontractors to carry commercial auto and provide COIs before working on their sites.
What is bobtail vs non-trucking liability insurance?
Both cover owner-operators when not under dispatch, but with different triggers. Bobtail insurance covers the truck when driving without a trailer, regardless of purpose. Non-trucking liability covers personal use only (driving home, running errands) and excludes any business activity. Most owner-operators need both their motor carrier's primary policy and either bobtail or non-trucking liability.
What is an MCS-90 endorsement?
A federal endorsement that guarantees your insurer pays liability claims for motor carriers with FMCSA authority. It protects the public, not you. If your commercial auto policy would otherwise exclude a claim (e.g., unauthorized driver), the MCS-90 forces your insurer to pay anyway, then seek reimbursement from you. Required for all carriers with active FMCSA operating authority.
Does commercial auto insurance cover tools and equipment in my vehicle?
Not automatically. Standard commercial auto covers the vehicle itself (collision and comprehensive) but not the contents. Tools, equipment, and materials require a separate inland marine or contractor equipment endorsement. If you carry $5,000+ in tools in your work truck, add this endorsement to avoid a costly gap.
How do I file a commercial auto insurance claim?
Report the accident to your insurer within 24 hours and file NY DMV Form MV-104 within 10 days. At the scene: document everything with photos, exchange information, and get a police report. Contact First Heritage Insurance Agency and we will guide you through the claims process, coordinate with the carrier, and advocate for a fair settlement.
Is commercial auto insurance tax deductible?
Yes. Commercial auto insurance premiums are a deductible business expense on Schedule C (sole proprietors), Form 1120 (corporations), or Form 1065 (partnerships). If you use a vehicle for both business and personal, you can only deduct the business-use percentage. Keep mileage logs to substantiate your deduction.
Can I get commercial auto insurance with bad driving records?
Yes, but expect higher premiums. As an independent broker, First Heritage Insurance Agency works with non-standard carriers like National General that accept drivers with violations, accidents, or SR-22 requirements. We compare options across 50+ carriers to find coverage even when other brokers cannot. Clean up MVRs over 3-5 years to qualify for standard rates.
How quickly can I get a commercial auto insurance quote?
Same day. First Heritage Insurance Agency controls the underwriting process through our exclusive Old Republic program and direct carrier appointments. We turn around quotes within hours, not the days or weeks you wait with national brokers. Same-day Certificates of Insurance (COIs) are also available for contractors who need fast turnaround for GC requirements.
